Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of EmoFlow-AI ("EmoFlow", "we", "us"), available at emoflow-ai.app. By accessing or using EmoFlow, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the service.

2. What EmoFlow is — and is not

EmoFlow is a private self-reflection and emotional-journaling tool: an interactive feelings wheel plus AI that helps you name and understand what you feel and reflect using evidence-based practices.

EmoFlow is not therapy, medical care, diagnosis, or treatment, and is not a substitute for a qualified mental-health professional. It is not a crisis or emergency service. If you are in crisis, or may harm yourself or someone else, contact your local emergency number or a crisis line immediately (for example, call or text 988 in the US, or see the crisis resources shown in the app). EmoFlow's AI is automated and cannot reliably detect an emergency, will not contact emergency services or any other person on your behalf, and must not be relied on for urgent safety needs.

3. Eligibility

You must be at least 13 years old to use EmoFlow. If you are under 18, you may use it only with the awareness and consent of a parent or guardian. EmoFlow is not directed to children under 13, and we do not knowingly collect data from them.

4. Accounts

The core feelings wheel and AI interpretation work without an account. Some features (the AI coach, cloud history, therapist sharing) require you to sign in. You are responsible for the accuracy of your information and for keeping your credentials secure.

6. AI-generated content

When you use the interpretation or coach features, you are interacting with an automated AI system — not a human, and not a licensed therapist, counselor, or medical professional. No human monitors these interactions in real time. Interpretations, insights, and coaching responses are generated by AI and offered as tentative, research-informed reflections — not professional advice, diagnosis, or instructions. AI can be inaccurate or incomplete. Use your own judgment and consult a qualified professional for any decision about your health or safety.

7. Acceptable use

You agree not to misuse the service: no unlawful use, no attempts to disrupt, scrape, reverse-engineer, or gain unauthorized access, and no use that harms others or infringes their rights.

8. Intellectual property

EmoFlow, its software, wheel, content, and branding are owned by EmoFlow-AI and protected by applicable laws. The emotions you select and the notes you write ("your content") remain yours; you grant us only the permissions needed to operate the service for you.

9. Disclaimers and limitation of liability

The service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. To the maximum extent permitted by law, EmoFlow-AI is not liable for indirect, incidental, or consequential damages, or for decisions you make based on the service. Nothing in these Terms limits any liability that cannot be limited under applicable law.

EmoFlow-AI is not a healthcare provider and is not a "covered entity" or "business associate" under the U.S. Health Insurance Portability and Accountability Act (HIPAA); the information you enter is not handled as protected health information (PHI) under that law. You understand that emotional self-reflection carries inherent limits, and you use EmoFlow at your own risk and assume responsibility for how you act on any reflection it provides.

10. Privacy

Your use of EmoFlow is also governed by our Privacy Policy, which explains what we collect and how it is handled.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use after changes take effect constitutes acceptance.

12. Governing law

EmoFlow-AI is operated by a limited liability company (LLC) registered in the State of Texas, USA. These Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-laws principles. Mandatory consumer-protection rights you have under the laws of your country of residence still apply.
